Lawsuit over pool chemical safety reinstated

Pool chemicals may be a health hazard.
A consumer group accused manufacturers of chlorine-detecting pool chemicals of violating state law by failing to disclose a cancer-causing ingredient, but an Alameda County judge dismissed their lawsuit because it failed to precisely identify the actual ingredient - which is also on the state's list of carcinogens.

But a state appeals court reinstated the suit.

The judge's hairsplitting is inconsistent with the disclosure law's purpose, "protection of the public from toxins," the appeals court said.

The suit was filed by Consumer Advocacy Group in 2007 and 2008 against eight makers or distributors of kits that test chlorine levels in swimming pools and spas.

The suit alleged that the products contained a chemical, orthotolidine, or OTO, that is on the state's list of substances known to cause cancer. A 1986 initiative, Proposition 65, requires businesses to warn the public of exposure to any chemical that can cause cancer or birth defects.

The manufacturers responded that the ingredient in their products was not OTO but another chemical, orthotolidine hydrochloride. That substance, which the appeals court described as a salt related to OTO, is also on the state's Prop. 65 disclosure list.

After a non-jury trial in 2010, Superior Court Judge Robert Freedman ruled that Prop. 65 required the consumer group to prove that the products contained OTO, but it had failed to do so.

He dismissed the suit and ordered the group to pay some of the manufacturers' court costs, which came to $60,000, according to the plaintiffs' lawyer.
The chemicals in question have been
linked to cancer in human beings.

In reviving the suit, the First District Court of Appeal said a public-protection measure such as Prop. 65 "must be construed broadly" to accomplish its goals.

The proper question in the case is whether the consumer group can prove that the products "exposed individuals to a listed chemical without a warning," said Justice Maria Rivera in the 3-0 decision.

The justices told Freedman to reconsider the case and decide whether the group's failure to specify the chemical had impaired the manufacturers' ability to put on a defense, and if not, whether they had violated Prop. 65.

Reuben Yeroushalmi, the consumer group's lawyer, said Wednesday that the manufacturers now have a Prop. 65 warning on their labels. He said the suit seeks penalty payments for past violations, which would be split 3-1 between the state and Consumer Advocacy Group.

The pool kits contain "one of the most insidious, dangerous products" sold in California, Yeroushalmi said. He said the group's lawsuits have prompted other companies to remove the ingredient from their products.

Stephen Marsh, a lawyer for the manufacturers, said the defendants are confident that they can show that they complied with Prop. 65.

Health club fumes an occupational hazard

A recent chemical fumes leak in a health club in South Wales serves as a reminder about how important clean air is in a work environment.

In the incident last Sunday, more than 25 fire and rescue service officers were dispatched to the men-only Greenhouse Health Club in Newport just after 9 pm, when a chemical leak was reported in.

An explosion in the club's pump room is being blamed. The chemicals stored in the room include hazardous substances used for sauna and pool maintenance.

Due to the explosion, a small amount of bromine was released, a chemical that is used to sterilize hot tubs, for example.

One person was treated and taken to the hospital after inhaling the chemical fumes.

There were eight clients in the club at the time.

The fire and rescue service officers secured the site and evacuated all guests, wearing chemical suits and breathing apparatus. The incident took almost five hours to resolve.

Pool chemical affects lungs of competitive swimmers: Study

Indoor pools exposing swimmers to chlorine may be tied to lung damage similar to that seen in people with mild asthma, according to a study cited in a Reuters article.

The French/Canadian study involved 23 elite swimmers, 10 mild asthmatics and 10 healthy, non-allergic people, who had to perform breathing tests and have their lung tissue tested. The samples were taken during the off-season.

The researchers found that the swimmers’ lung tissue samples had almost six times as many immune cells associated with asthma and allergies, compared to the lung tissue of healthy participants.

It was a similar amount to the lung tissue in mild asthmatics.

Unlike the healthy participants, both swimmers and asthmatics groups had evidence of scar tissue in the lungs.

The results do not mean that elite swimmers will develop asthma later, as inflamed lung tissue was not associated with asthma symptoms like coughing and wheezing.

However, more research may need to be done about the effect of chlorine in water and air as well as the chlorine byproducts that are formed when chlorine reacts with human sweat, urine and hair, for example.

Some of these byproducts may be hazardous to human health escape into the air just above the waterline, where swimmers breathe them in, the researchers say.

The chemical exposure may also make swimmers more sensitized to allergens like pet dander, pollen and dust. More than half of competitive swimmers are sensitive to these allergens, the researchers say.

Still, the benefits of physical exercise may still outweigh any concerns.

The researchers’ tips for reducing chemical exposure in pools include:
  • Avoid pools with a strong chlorine smell in the air. This is a sign that pool chemicals are badly managed
  • Try saltwater pools (although they also use chlorine)
  • Practice good hygiene: Always take a shower before entering a pool; never use it as a urinal

For professional swimmers and lifeguards, the constant exposure to chemicals and odors in indoor swimming pools may lead to health problems down the road.

The chlorine used in the water and chloramines, which are formed when chlorine reacts with other contaminants give off strong odors, and previous studies have linked swimming in indoor pools with asthma and bronchitis in children.

Chlorine is such a common ingredient in pool water and tap water because it inactivates most disease-causing germs in seconds.

But each swimmer that delves into a pool is inadvertently adding contaminants to the water, including sweat, hair, urine, makeup, sunscreen and more.

When these pollutants react with the chlorine, they produce strong-smelling chloramines – an odor that regular indoor swimmers are familiar with.
