Medical center exposed workers to asbestos, other health hazards: OSHA

All employers must keep their workers safe, OSHA says.
Aleda E. Lutz Veterans Administration Medical Center employees in Saginaw were exposed to asbestos, bloodborne pathogens and unsafe operation of powered industrial vehicles, a U.S. Department of Labor Occupational Safety and Health Administration inspection found.

OSHA issued six notices of unsafe or unhealthful working conditions following the March 2014 inspection initiated as part of OSHA's Federal Agency Local Emphasis Program*.

"The Veterans Administration Medical Center failed to ensure that the facility was a safe and healthy workplace because it did not provide appropriate personal protective equipment or train employees how to keep themselves safe," said Larry M. Johnson, director of OSHA's Lansing Area Office.

"All employers, including federal employers, are responsible for knowing the hazards in their facilities. They must follow standards to protect worker safety and health."

OSHA's inspection found that officials failed to remove a broken, powered industrial vehicle from service, resulting in one repeat violation. The U.S. Department of Veterans Affairs' facility in Battle Creek was cited for the same safety violation in 2013.

To issue notices for repeat violations, OSHA must issue at least one other notice for the same violation, within the same standard industrial classification code, at another agency establishment. Thousands of workers are injured every year, sometimes fatally, while operating powered industrial vehicles.

In addition, OSHA found five serious violations for failure to ensure employees wore masks and eye protection whenever they could expect exposure to splashes, spray, spatter or droplets of blood or other infectious material, and to ensure that work surfaces were properly decontaminated.

Facility officials did not ensure that powered industrial truck operators completed training successfully or that employees who performed housekeeping duties were provided asbestos awareness training. Additionally, the facility used a power strip that exceeded acceptable voltage levels.

A serious notice is issued when there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known.

As required by the Occupational Safety and Health Act, federal agencies must comply with the same safety standards as private sector employers.

The federal agency equivalent to a private sector citation is the notice of unsafe and unhealthful working conditions. A notice is used to inform establishment officials of violations of OSHA standards, alternate standards and 29 Code of Federal Regulations citable program elements.

OSHA cannot propose monetary penalties against another federal agency for failure to comply with OSHA standards.

The medical center has 15 business days from receipt of its notices to comply, request an informal conference with OSHA's area director, or appeal the notices by submitting a summary of the agency's position on the unresolved issues to OSHA's regional administrator.

Home health care workers get recognition

OT, minimum wage extended to health care workers

may limit access for some families.
The Obama administration approved rules that extend minimum wage and overtime pay to nearly 2 million home health care workers who help the elderly and disabled with everyday tasks such as bathing, eating or taking medicine, according to an AP report.

Home care aides have been exempt from federal wage laws since 1974, when they were placed in the same category as neighborhood baby sitters. But their ranks have surged with the aging population and the field is now one of the fastest-growing professions.

Labor unions and worker advocacy groups have been seeking the change for years, arguing that nearly half of caregivers live at or below the poverty level or receive public benefits such as food stamps and Medicaid.

But some health care companies claim new overtime requirements will make it tougher for families to afford home care for their aging parents. Lobbyists for the $84 billion industry argue the new requirements could reduce the quality of care and even lower the take-home pay of caregivers if companies decide not to send workers out for shifts longer than eight hours.

The new rules will take effect in January 2015, which will give time for states and industry providers to adjust to the new requirements. New wage and hour rules typically take effect within 60 days after final approval. The rules cover home health aides, personal care aides and certified nursing assistants that provide care to the elderly and people with injuries, illnesses and disabilities.

President Barack Obama first proposed the rules nearly two years ago as part of broader effort to boost the economy and help low-income workers struggling to make ends meet. More than 90 percent of home care aides are women. About 30 percent are black, and 12 percent are Hispanic.

Experts estimated that by 2020, the country would need about 4 million home care aides to meet the needs of its graying population. The number of Americans over 65 is expected to nearly double over the next 20 years.

Fifteen states already extend state minimum wage and overtime protections to home care workers, and another six states and Washington, D.C., mandate state minimum wage protections.

The current median pay for home care workers is about $9.70 per hour, higher than the federal minimum wage of $7.25 an hour, according to Labor Department figures. But overtime pay could help lift wages substantially for those who work more than 40 hours a week.

The new rules will continue to exempt from minimum wage and overtime requirements those workers who mainly visit the elderly to provide company or engage in hobbies and are employed directly by the person or family receiving services.

Massachusetts medical provider cited by OSHA after workers exposed to biohazards

A medical service provider in Newton, Massachusetts has been cited by the U.S. Department of Labor's Occupational Safety and Health Administration for an alleged  "willful and serious violation" of workplace safety standards after an OSHA inspection revealed that workers were being exposed to biohazards. The proposed penalties for New England Hematology/Oncology Associates PC, is over  $46,000.

An inspection was made in April in response to complaints by medical workers that the needles used to treat cancer patients were not safety-engineered devices and that, in removing the needles, workers were at risk of needlestick injuries. OSHA found that the workers were potentially exposed to bloodborne pathogens from needlesticks because safer needle systems, such as automatically sheathing needles, were not used.

OSHA also found that the medical provider had been made aware by workers that a safer needle system was needed but continued to use a system that was not engineered to reduce the risk of injury.

"The willful violation exists because the employer initially agreed to address the issue, as required by the regulation, but did not follow through," said Jeffrey Erskine, OSHA's area director in Andover. "This medical provider put workers at risk of coming into contact with needlestick injuries because it failed to use the safest technology available to them."

OSHA also has issued a citation with a $4,900 fine for one serious violation that involves failing to review and update an exposure control plan; document the evaluation and implementation of appropriate, commercially available and effective medical devices designed to minimize occupational bloodborne pathogen exposure; and document employees' hepatitis B vaccination status. A serious violation occurs when there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known.
