Welders exposed to toxic substances at storage tank manufacturing company

Welding without proper safety precautions can expose workers
to hazardous chemicals and fumes. 
Workers welding stainless steel and other alloy steels containing chromium metal at a Wisconsin bulk storage tank manufacturer were exposed to hazardous levels of hexavalent chromium.

At high levels, hexavalent chromium can cause lung cancer and respiratory, eye and skin damage.

After a complaint, U.S. Department of Labor Occupational Safety and Health Administration inspectors visited Imperial Industries in Rothschild and identified two willful and 12 serious safety violations.

Proposed penalties total $161,100.

"Each year 50,000 workers die from exposures to hazardous substances like chromium during their careers. Failing to take steps to limit exposure to this dangerous substance is inexcusable," said Robert Bonack, area director of OSHA's Appleton office.

"Workers pay the price when companies don't follow standards to reduce injuries and illnesses. Imperial Industries needs to take immediate steps to comply with safety and health standards."

Inspectors determined employees were exposed to hexavalent chromium at levels exceeding permissible exposure limits while welding steels containing chromium metal. Chromium is added to harden alloy steel and help it resist corrosion.

Additionally, the company failed to implement engineering controls to reduce and monitor exposure levels among workers.

The November 2014 investigation also found workers endangered by amputation and struck-by hazards because machines lacked safety mechanisms. Numerous electrical safety hazards were also identified, and workers were found operating damaged powered industrial vehicles.

Imperial Industries manufactures heavy gauge metal industrial tanks that are typically mounted to commercial trucks.

Under the Occupational Safety and Health Act of 1970, employers are responsible for providing safe and healthful workplaces for their employees.

OSHA's role is to ensure these conditions for America's working men and women by setting and enforcing standards, and providing training, education and assistance.

Chicago has most air-conditioned homes: Study

Humidity and temperature determines
the number of air conditioned homes.
You might think that hot climates drive the demand for indoor air conditioning.

But the results of a recent study on the prevalence of homes with HVAC systems might surprise you.

When it comes to demand for homes with central air conditioners, it’s not the heat; it’s the humidity.

A RealtyTrac analysis of homes in U.S. cities with more than 100,000 residents showed that cities with high humidity and temperatures, not just one or the other, have the most homes with central air.

Yet Chicago, which is among neither the hottest nor the most humid cities, outranked scorchers like Houston, Miami, and Phoenix on RealtyTrac’s list of “coolest” cities.

Rounding out the list where central A/C is a must-have were Philadelphia; San Antonio, TX; Portland, OR; Las Vegas; Los Angeles; St. Louis, MO; Orlando, FL; Jacksonville, FL; Atlanta; Charlotte, NC; and Indianapolis.

Except for a few West Coast cities with mild, year-round climates, air conditioners come standard in most new homes, according to the U.S. Department of Energy.

As their use increases, builders have been able to upsell more energy-efficient models.

Don't let poor IAQ affect productivity

Toxic solvents underneath IBM building defy cleanup

Buildings on contaminated soil may
expose workers to harmful chemicals
through soil vapor intrusion: Experts.
ENDICOTT – After 35 years, IBM Corp. contractors have stanched the flow of industrial solvents into a commercial and residential district in the heart of the village, but they have yet to find a solution for the source of the problem at the company's former flagship manufacturing plant.

Officials recently reported that efforts to intercept and remove the subterranean flow of hazardous chemicals coming from the industrial complex — now owned by Huron Real Estate Associates — have been successful.

Consequently, health risks to a nearby neighborhood have been eliminated.

Yet they have no remedy for a concentrated pool of solvents directly under the manufacturing site, where at least 1,500 people still work.

It may take years before a proven remedy is found, according to Alex Czuhanich, an engineering geologist with the state Department of Environmental Conservation, although the agency has no timetable for the project.

The pollution, discovered in 1979, includes trichloroethylene (TCE) and other solvents used as industrial degreasers that have been linked to maladies ranging from cancer to birth defects.

IBM used vast quantities of the solvents to manufacture printed circuit boards during the company's heyday from the 1950s through the 1970s.

The contaminated hot spot — known as "the source area" on DEC records — lies under an area the size of eight village blocks, and it was once bustling with the delivery, handling, storage, transport and liberal use of solvents.

The source area encompasses a railroad corridor where chemicals arrived in bulk, loading docks where they were handled, and a network of tanks and pipelines that stored and transported virgin chemicals and chemical waste to and from various manufacturing lines throughout the campus, according to DEC records.

Situated over and near the source area, and blocking access to cleanup, are dozens of buildings, most of them massive, bunker-like, cement structures built during the Cold War era and some well before.

The contaminated ground is dense with tunnels, boiler rooms, tank rooms, crawl spaces, cables, pipes and conduits.

"There is just so much infrastructure there," Czuhanich said. "Trying to get anything in there (to remedy the problem) is difficult, at best."

To date, nearly 70,000 gallons of solvent — more than 40 tons — have been pumped from the ground. Officials don't know how much is left, according to DEC spokesman Peter Constantakes.

Court records filed by attorneys representing residents suing IBM for damages from the pollution put the solvent pool up to 1 million gallons "that had apparently collected over many years from leaking pipes and tanks."

Reluctance by IBM and the DEC to publicly discuss the source area has added to uncertainty about its status. IBM spokesman Todd Martin did not reply to phone calls or written inquires on the subject.

Safety debated

IBM sold the plant in 2002 to Huron Real Estate Associates, which now rents space to BAE Systems Electronics, i3 Electronics (formerly Endicott Interconnect), Binghamton University and other smaller firms that collectively employ between 1,500 and 2,000 workers.

TCE, the main contaminant under the campus, is not commonly used in bulk by industry in the U.S. anymore, though it is a pervasive contaminant at many Cold War-era industrial and military sites throughout the country.

In addition to the former IBM site, notorious TCE legacy sites in the Southern Tier include the CAE Electronics site in Hillcrest, and the Morse Industrial site in Tompkins County, both linked to contamination of nearby residential neighborhoods.

The TCE problem is as stubborn as it is complex. TCE is one of a class of chemicals that tend to be heavier than water, so they sink through the water table and adhere stubbornly to soil particles.

They also give off toxic fumes that rise from the ground, ending up in basements, crawl spaces and — ultimately — circulating into living spaces through a process known as vapor intrusion.

There is no national standard to limit TCE exposure in air, although there has been a political push to develop one since the federal Environmental Protection Agency determined in 2011 that the chemical was a carcinogen and a "non-cancer health hazard."

Just how much exposure presents a risk remains a controversial topic. Levels that might not affect one person could make another seriously ill. Pregnant women are particularly vulnerable.

According to the latest EPA assessment — challenged by the chemical industry — risks for non-cancer illnesses, such as birth defects, from short-term TCE exposure in residential settings are found to increase statistically at levels at or above 2 micrograms per cubic meter.

The agency has set the threshold for risks from short-term exposure in an industrial setting at 7, based on the assumption that people spend less time at work than in their homes.

Cancer risks become discernible for chronic exposure — the type people might experience in homes — at levels beginning at 0.43 micrograms, according to an EPA assessment.

New York state has set a broad guideline of 5 for residential and commercial exposure. But the agency often requires action at levels below the threshold when feasible.

Feasibility remains the issue at the Huron campus. Indoor air samples at 42 buildings collected in 2005 — the last time the state oversaw testing — ranged from zero to 17 micrograms per cubic meter in some areas that tended to be occupied. Levels were much higher in other areas — often registering between 50 and 300 micrograms in tunnels and tank rooms below Building 18, for example.

Concentrations in the soil directly below the buildings often exceeded 10,000 and sometimes were over 100,000 micrograms.

In 2005, the state health department determined that the TCE levels at the Huron campus present a "low" health risk to people working there, according to a report at the time. That means state health officials "do not expect to be able to associate health effects" from exposure.

Health department spokesman Jeffrey Hammond said the guideline remains "under review" as more information comes to light "to ensure that previous decisions and recommendations continue to protect public health."

In 2005, a health department study found elevated rates of testicular and kidney cancers, and birth defects that were "statistically significant" in an area affected by solvent pollution in the area south of the former IBM plant, and several blocks to the southwest of the plant polluted by an undetermined source. (The area has since been cleaned by the IBM remediation efforts.)

The results of a study by NIOSH and the health department evaluating birth outcomes of women who worked at the plant is expected to be released later this year.

EPA proposes record-keeping rules for nanoscale chemicals

For the first time the agency will use TSCA authority to collect health and safety information on nanoscale chemical substances already in use

WASHINGTON D.C., – The U.S. Environmental Protection Agency (EPA) is proposing one-time reporting and recordkeeping requirements on nanoscale chemical substances in the marketplace.

“Nanotechnology holds great promise for improving products, from TVs and vehicles to batteries and solar panels, said Jim Jones, EPA’s Assistant Administrator for Chemical Safety and Pollution Prevention.

“We want to continue to facilitate the trend toward this important technology. Today’s action will ensure that EPA also has information on nano-sized versions of chemicals that are already in the marketplace.”

EPA currently reviews new chemical substances manufactured or processed as nanomaterials prior to introduction into the marketplace to ensure that they are safe.

For the first time, the agency is proposing to use TSCA to collect existing exposure and health and safety information on chemicals currently in the marketplace when manufactured or processed as nanoscale materials.

The proposal will require one-time reporting from companies that manufacture or process chemical substances as nanoscale materials.

The companies will notify EPA of:

  • certain information, including specific chemical identity; 
  • production volume; 
  • methods of manufacture; processing, use, exposure, and release information; and, 
  • available health and safety data. 

Nanoscale materials have special properties related to their small size such as greater strength and lighter weight, however, they may take on different properties than their conventionally-sized counterpart.

The proposal is not intended to conclude that nanoscale materials will cause harm to human health or the environment; Rather, EPA would use the information gathered to determine if any further action under the Toxic Substances Control Act (TSCA), including additional information collection, is needed.

The proposed reporting requirements are being issued under the authority of section 8(a) under TSCA. The agency is requesting public comment on the proposed reporting and recordkeeping requirements 90 days from publication in the Federal Register. EPA also anticipates holding a public meeting during the comment period. The time and place of the meeting will be announced on EPA’s web page.

Is it possible to repurpose polluted land?

Ex-shipyard in Amsterdam houses shops and offices

Polluted land doesn't have to stay
abandoned, experts say.
Although Amsterdam’s latest urban experiment, De Ceuvel, is built on solid ground, there’s much that reminds its denizens — artists, entrepreneurs, designers, sustainability experts — of its past as a commercial shipyard.

Converted rowboats serve as benches, stranded houseboats are used as buildings and — raised 90 centimeters, or 35 inches, off the polluted ground — a quay-like walkway constitutes the sidewalk.

De Ceuvel officially opened this summer after a team of architects, landscapers, sustainability experts and entrepreneurs created 1,250 square meters, or 13,450 square feet, of office, studio and commercial space on a polluted plot of land in the city’s industrial north.

Besides producing its own power and minimizing waste, the design aims to create a fertile ground for community interaction, while letting the area’s physical ground recuperate from its industrial past, explained Pieter Theuws, the lead landscape architect on the project.

“Our challenge is to connect streams of waste and energy and people into a circular city model,” he said.

Commitment to urban experimentation

The project is an example of Amsterdam’s commitment to urban experimentation. A few kilometers north of the centuries-old city center, artist spaces and urban experiments like De Ceuvel and NSDM, another large abandoned industrial harbor space turned into studios, or Ijburg, a community of floating houses moored off reclaimed land, are part of the city’s innovative growth initiatives.

The physical pieces needed to create De Ceuvel were 16 old houseboats, phytoregenerative plants, bio water filters, a thermophilic compost, solar panels and the long pathway. The human contribution, its creators say, included lots of physical labor, a willingness to fight administrative bureaucracy and a desire to share the place with the public.

“All of it is to attract a lot of people, to get a lot of people here, so that they get in contact with the sustainability stories,” said Sascha Glasl, who dreamed up the project and is its lead architect.

De Ceuvel won the Frame Public Dutch Design award in October. The annual prize, ultimately decided by a voting public (both online and at the Dutch Design week) is given to innovative designers. “De Ceuvel gives the impression of a utopia that has actually been accomplished,” wrote the prize selection committee.

Project focused on houseboats

Houseboats were always the soul of the project, Mr. Glasl said. Not only were they ideally suited to be plotted, without foundation, on land best left untouched, but they could be converted into innovative spaces before being towed up harbor and placed on the site by crane. This allowed the designers leeway, since city housing permits are not required to bring houseboats on land.

The original tenants were found through an advertisement on Marktplaats, a Dutch ad site, which asked potential tenants to chose one of the houseboats on sale that week, pretend that they could buy it for one euro and explain what they would do with it.

And, in fact, most of the houseboats were acquired for that nominal sum. As Amsterdam’s canals gentrify, and moorings are being leased by wealthier and more demanding residents, old boats are being scrapped to make way for new.

The offer to take the boats for a euro proved so popular that Mr. Glasl, a principal with the Amsterdam architectural office Space & Matter, and his team had to choose among offers.

The project was funded by the city through a 250,000-euro, or $313,000, start-up grant and a further €200,000 bank loan that it guaranteed. Those funds paid for materials, plants and some of the professional services required to make De Ceuvel a reality. Both volunteers and the development partners invested hundreds of hours of work, ultimately bringing down the price tag.

The tenants, who often share the boats, pay approximately €65 per square meter of workspace each year — a song in comparison with commercially available art spaces which, in Amsterdam, can fetch that much each month. The proceeds, Mr. Glasl said, are being used to pay off the guaranteed loan over the next nine years.

While the houseboats retain their original shapes, much has been done to make the interiors suitable for modern offices. Some roofs have been raised and outside paneling renewed, in some cases using freshly felled Dawn Redwood from a nearby street enlargement.

Designed to ease pollution

Many aspects of the design are positive for the polluted land on which it sits, said Mr. Theuws, an associate at Delva, a Dutch-Belgian landscape architectural firm responsible for landscaping and choosing the area’s flora.

Grasses, fireweed, foxglove, black willow and eastern cottonwood were chosen either to digest pollutants in the ground or absorb metals left behind.

Despite all the pollution — before the area housed a shipyard, Amsterdam dumped its canal sludge there in the 19th century — the ground, he says, is actually not particularly poisonous to humans.

Solar panels have been installed on roofs and biofilters installed to clean waste water from the sinks. Each boat has been equipped with a composting toilet, making them independent from the city sewer system.

Capturing rainwater to make drinking water was blocked by the city because that would have meant licensing the community as a drinking water provider — which was too complex and costly. In the end the community opted to bring in city water, although the ateliers are not connected to the sewer system. Commercial spaces and the cafe are connected.

Cosmetics industry tackles air pollution effects

Pollution can accelerate normal
aging, experts say.
Many people want younger looking skin and one of the ways to do that includes protecting it from sun damage.

But now a slew of products are also claiming to protect skin from pollutants in the air.

Actress Aicha Reid has had a strict skincare regimen since high school. Lately, she's noticed the damage to her skin from air pollution.

"It's happened before where I'm walking by a bus and then all of a sudden there's just like this thick black smoke just wafting into my face and I'm just like, 'my pores!'" she said.

Reid is not alone. A recent Mintel report found that in the U.S. 34 percent of women are concerned about the effects of pollution on their skin, and cosmetic companies are taking notice.

"There's been an explosion of products that are either being developed or remarketed for the purpose of decreasing damage from air pollution," said Dr. Amy Derick a board-certified dermatologist and American Academy of Dermatology member.

Products are now being promoted to remove particulates from the skin, or neutralize free radicals, which are molecules experts say injure the skin's cells and cause inflammation.

"Pollution can accelerate normal aging by breaking down collagen and increasing free radicals in the skin, so I think that it can accelerate the aging process in certain people," Derick said.

Experts said exposure to pollution over time can lead to dullness, wrinkles and dark spots. Dr. Derick recommends using a cleansing brush to decrease the amount of pollution left on your skin overnight and also a topical antioxidant.

Dr. Elizabeth Tanzi, a board-certified dermatologist and American Academy of Dermatology member, said researching products is essential.

"Find out what products have been shown to be scientifically helpful. Find out which ones are not just jumping on the pollution bandwagon, and those that have really gone and put in some research behind it," she said.

Reid said her skin looks even better now that she is paying attention to the air around her.

"I've noticed a major improvement in my skin since I started taking, you know, proper steps to sort of counter the effects of air pollution damage," Reid said.

Industry studies are underway to further investigate the effects of pollution on different types of skin. Industry experts also said we can expect even more anti-pollution skin care products on the market in the near future.

Fracking may be as dangerous as asbestos: Report

The health effects of fracking are still
unknown, scientists warn.
Fracking could carry unforeseen risks in the way that thalidomide, tobacco and asbestos did, warns a report produced by the UK government’s chief scientific adviser.

A chapter in the flagship annual report produced by the UK’s chief scientist, Mark Walport, argues that history holds many examples of innovations that were adopted hastily and later had serious negative environmental and health impacts. The chapter is written by Prof Andrew Stirling of the University of Sussex.

The controversial technique, which involves pumping chemicals, sand and water at high pressure underground to fracture shale rock and release the gas within, has been strongly backed by the government with David Cameron saying the UK is “going all out for shale”.

But environmentalists fear that fracking could contaminate water supplies, bring heavy lorry traffic to rural areas, displace investment in renewable energy and accelerate global warming.

The chapter in the report produced by the chief scientific adviser appears to echo those fears. “History presents plenty of examples of innovation trajectories that later proved to be problematic — for instance involving asbestos, benzene, thalidomide, dioxins, lead in petrol, tobacco, many pesticides, mercury, chlorine and endocrine-disrupting compounds...” it says.

“In all these and many other cases, delayed recognition of adverse effects incurred not only serious environmental or health impacts, but massive expense and reductions in competitiveness for firms and economies persisting in the wrong path.”

Thalidomide was one of the worst drug scandals in modern history, killing 80,000 babies and maiming 20,000 babies after it was taken by expectant mothers.

Fracking provides a potentially similar example today, the report warns: “... innovations reinforcing fossil fuel energy strategies — such as hydraulic fracturing — arguably offer a contemporary prospective example.”

Stirling’s chapter also argues that the UK and the world could tackle climate change with energy efficiency and renewable energy alone but vested interests in the fossil fuel industry stand in the way.

There is a “clear feasibility of strategies built entirely around energy efficiency and renewable energy”, the report, published late last year, says. “Yet one of the main obstacles to this lies in high-profile self-fulfilling assertions to the contrary, including by authoritative policy figures.”

“In energy... the obstacles to less-favoured strategies [such as energy efficiency and renewables] are typically more commercial, institutional and cultural than they are technical. Among the most potent of these political obstructions are claims from partisan interests — such as incumbent nuclear or fossil fuel industries — that there is no alternative to their favoured innovations and policies.”

A spokesman for the Royal Academy of Engineering, which produced an influential 2012 report on shale gas with the Royal Society that concluded it could be safe if it was properly regulated, said the risks from fracking were very low.

“Our conclusion was that if carried out to highest standards of best practice, the risks are very low for any environmental contamination. The most serious risks come in the drilling and casing and surface operations rather than the fracturing itself.”

“You can’t eliminate the risk of something going wrong, but you can monitor very closely and be very open and transparent about what’s going on.”

On the chief scientific adviser’s report, he said: “I think he’s making a very broad and general point.”

Greenpeace UK’s energy campaigner, Louise Hutchins, said: “This is a naked-emperor moment for the government’s dash to frack. Ministers are being warned by their own chief scientist that we don’t know anywhere near enough about the potential side effects of shale drilling to trust this industry. The report is right to raise concerns about not just the potential environmental and health impact but also the economic costs of betting huge resources on an unproven industry. Ministers should listen to this appeal to reason and subject their shale push to a sobering reality check.”

Failing to address serious hazards may be costly for companies

PARIS, Ill. – Workers were exposed to combustible cornstarch dust, dust particles in excess of permissible exposure limits and other hazards at Septimus Inc.

The U.S. Department of Labor's Occupational Safety and Health Administration has cited the company for 21 serious safety and health violations, carrying proposed penalties of $46,400.

A complaint prompted the inspection at the facility, which processes cornstarch for use in laundry detergent and other products.

"Combustible dust can burn rapidly and explode with little warning, putting workers at risk for severe injury and death," said Thomas Bielema, OSHA's area director in Peoria.

"OSHA's inspection found that Septimus used potential ignition sources, like forklifts and electrical equipment, in areas where combustible dust was present."

OSHA's April 30, 2014, inspection found workers were exposed because processing and dust collection equipment lacked protective covers.

If this dust is suspended in the air in the right concentration, under certain conditions, it can become explosive.

The inspection found the company operated powered industrial vehicles in poor repair that were not rated for use in environments where combustible dust was present.

These vehicles, along with numerous electrical violations, provided potential ignition sources for the dust. The force from such an explosion can cause employee deaths, injuries and destruction of buildings.

The U.S. Chemical Safety and Hazard Investigation Board identified 281 combustible dust incidents between 1980 and 2005 that led to the deaths of 119 workers, 718 injuries and numerous extensively damaged industrial facilities.

Workers were also exposed to airborne concentrations of dust in excess of the permissible exposure limit, which can cause respiratory illness and lung disease. The company failed to implement administrative and engineering controls to reduce exposure limits.

Additional serious violations involved amputation hazards and included lack of machine guarding, failure to implement specific lockout/tagout procedures to prevent machinery from operating during service and maintenance, and workers exposed to fall hazards of 7 feet or greater from unguarded working platforms.

The company also failed to train workers about hazardous chemicals in use at the facility and to mark exit routes clearly and ensure they were free of obstructions.

A serious violation occurs when there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known.

Septimus has a contract with Tate & Lyle to extrude, dry blend and package cornstarch. The company is owned by The Faultless Starch/Bon Ami Co. of Kansas City, Missouri.

Septimus has 15 business days from receipt of its citations and penalties to comply, request an informal conference with OSHA's area director, or contest the findings before the independent Occupational Safety and Health Review Commission.

Under the Occupational Safety and Health Act of 1970, employers are responsible for providing safe and healthful workplaces for their employees.

OSHA's role is to ensure these conditions for America's working men and women by setting and enforcing standards, and providing training, education and assistance.

Carpet industry at forefront of innovation

New carpet smell used to be considered an asset. After all, it meant a new product.

But in recent years, customers have been asking for carpets that don't "off-gas," meaning carpets that won't release chemicals, which may be hazardous to health.

And the carpeting industry seems to have taken the hint.

For one thing, most carpets no longer release those volatile organic compounds, or VOCS, that come from the glues or other components. Consumers should look for the industry-run certification Green Label Plus.

More carpet is made of recycled content, and more is being recycled all the time.

Indeed, the carpet industry has been a leading innovator in construction, said Janet Milkman, executive director of the Delaware Valley Green Building Council.

"They've been analyzing the environmental impacts of their products and processes for years, and are now looking deeply into the human health impacts," she said.

Experts credit the U.S. Green Building Council's building certification system, LEED (Leadership in Energy and Environmental Design), which sets standards and drives purchasing decisions.

The thousands of buildings across the nation that are now LEED-certified represent countless phone calls to manufacturers from architects and interior designers asking about all kinds of environmental considerations, said Max Zahniser, who once ran the LEED certification program but returned to Philadelphia seven years ago to start a green consulting firm, Praxis Building Solutions.

Enough of those, and manufacturers take heed.

Hurdles remain

While American rugmakers have stopped using stain repellents made from perfluorinated chemicals, some think the replacements aren't much better. And carpet made abroad, even if it's for a U.S. company, may contain the old chemicals.

Some companies still use vinyl plastic in the backing; triclosan may be used as an antimicrobial as well. Both are linked to health effects, said Michael Schade, a campaign director with the nonprofit advocacy group, Safer Chemicals/Healthy Families. Ask, he said, and choose alternatives.

Last year, researchers at the Healthy Building Network, a nonprofit that works to reduce the use of hazardous chemicals in building products, looked at 50 "asthmagens" - substances that can cause asthma - in carpet and other building materials.

Only three were covered by the leading indoor air quality protocols, said Jim Vallette, one of the researchers.

There seems to be no end to things consumers should consider.

Deep-pile or not? Over time, deep-pile carpet will generally harbor more microbiotic organisms.

Natural wool or manmade fiber such as nylon? Wool often does not have stain-resistant chemicals or flame-retardants, another group of chemicals that concern health professionals. But it's not very durable, and so is less sustainable.

Nylon is durable, but it's made from petrochemicals. Then again, it's recyclable.

That's another major industry advance, experts say. Many companies have take-back programs for older, less environmentally friendly carpeting.

But in the push to increase the proportion of recycled materials in carpet in order to meet sustainability goals, some manufacturers are using coal fly ash - a byproduct from coal-fired power plants that may contain heavy metals - as a filler in the carpet backing.

Whatever type of carpeting you get, the advice of experts is to take care of it - extending its lifespan and reducing its environmental footprint (not to mention the drop in your bank account).

That includes cleaning it with a vacuum or chemicals that are too brutal on the poor rug. The institute's website (www.carpet-rug.org) lists its approved vacuums and cleaners.

OSHA to improve tracking of workplace injury and illness

The Occupational Safety and Health Administration announced it will extend the comment period on the proposed rule to improve tracking of workplace injuries and illnesses to Oct. 14, 2014.

The proposal, published on Nov. 8, 2013, would amend the agency's record-keeping regulation to add requirements for the electronic submission of injury and illness information that employers are already required to keep.

During the public meeting held on the proposal, many participants expressed concern that the proposal may create motivation for employers to under-record injuries and illnesses, since each covered establishment's injury and illness data would become publicly available on OSHA's website.

Participants also expressed concern that the proposal would lead to an increase in the number of employers who adopt practices that discourage employees from reporting recordable injuries and illnesses. OSHA is concerned that the accuracy of the data collected under the new proposal could be compromised if employers adopt these practices.

"OSHA wants to make sure that employers, employees and the public have access to the most accurate data about injuries and illnesses in their workplaces so that they can take the most appropriate steps to protect worker safety and health," said Assistant Secretary of Labor for Occupational Safety and Health Dr. David Michaels.

Therefore, OSHA is soliciting comments on whether to amend the proposed rule to: 1) require that employers inform their employees of their right to report injuries and illnesses; 2) more clearly communicate the requirement that any injury and illness reporting requirements established by the employer be reasonable and not unduly burdensome; and 3) provide OSHA an additional remedy to prohibit employers from taking adverse action against employees for reporting injuries and illnesses.

A cleaner way to separate coal and ash

New technology separates coal, ash without chemicals

The new technology is new but has
the potential to curb contamination.
The DriJet 100 is a new technology that can separate coal from ash without using water or chemicals.

The technology, developed by Pennsylvania-based Mineral Separation Technologies, uses x-rays to scan and separate coal from ash. That means it's cleaner, portable and more reliable than traditional coal prep plants.

It's also safer, faster and much more economical.

"It eliminates a lot of risk for us, a lot of potential exposure, that's what we like about it," West Virginia Coal Reclamation Managing Partner Gene Ricciardi said. "It provides on-site separation and cleaning, so we don't have to worry about transporting large volumes of coal in trucks — we're going to be transporting probably one-third of amount in trucks that we normally would.

"There's a lot less possibility of contamination into the water system and air."

The Kanawha County company was first in the industry to purchase the technology, but Ricciardi and his partner, Joe Cornfield, are satisfied it will live up to the hype. Though their system isn't operational yet, Ricciardi said they've run their coal through the machine "and it's worked."

Mineral Separations CEO Charles Roos said the patented technology uses x-rays to identify the atomic weight of the coal particles and then air jets separate coal from ash. The ash is removed from the coal right at the mine face.

"The technology was developed for separating recycled metals and recycled plastics; it's been used for years in that industry," he said. "There have been hundreds of installations around the world in recycling plants.

"About five years ago we noticed electronics had gotten fast enough and sensors fast enough that we could use the technology on (other) material streams."

Roos said the technology means fewer coal trucks on the road and less coal waste in impoundments, both positive changes for the industry. It also requires less horsepower and fewer moving parts, which cuts operating costs.

The DriJet can process 20,000 pieces of coal per second and deliver a higher quality product.

Tension over outdated regulations in cosmetics industry

Concerned about old regulations that have left it with little power to ensure the safety of thousands of consumer products, the Food and Drug Administration launched talks with the cosmetics industry more than a year ago.

The goal was to reach a deal on a regulatory regime that has not changed since 1938.

The regulator and the regulated appeared to reach a rare kumbaya moment last summer — an agreement on the outline of legislation to beef up the agency’s authority while giving the industry greater certainty.

But the talks collapsed, and those once-promising private discussions have given way to public pronouncements of disillusionment, frustration and distrust.

In a letter, a top FDA official charged that the cosmetics industry’s latest proposals would undercut the government’s already weak authority, prevent states from undertaking enforcement actions and “put Americans at greater risk from cosmetics-related illness and injury than they are today.”

In his letter, FDA Deputy Commissioner Michael Taylor told two trade groups representing the $60 billion-a-year industry that there is no longer enough common ground to “justify devoting further taxpayer resources to this negotiation.”

The Personal Care Products Council, which represents an estimated 600 companies, quickly rejected the notion that it wants to weaken federal oversight of cosmetics, and it said suggestions that cosmetics products are dangerous are reckless, counterproductive and not supported by data.

“We are extremely disappointed that FDA has indicated they will not participate in further discussions,” Lezlee Westine, the group’s president, said in a statement. “We all share in the common goal of protecting consumers. In fact, product safety is the cornerstone of all that this industry represents. . . . We will work with Congress to pursue meaningful solutions.”

Tests revealed toxic ingredients in popular products

The stalemate has proved particularly galling to consumer advocacy groups, who have long pushed for more government oversight over the chemicals used to produce millions of products used by Americans every day, from lipstick and hair spray to toothpaste, deodorant and baby lotion.

Janet Nudelman, director of the California-based Campaign for Safe Cosmetics, said the industry’s proposals — which could put the onus on the FDA to prove that questionable chemicals are unsafe and could preempt some state regulations — are “a slap in the face” to Americans who expect transparency about the products they use.

“Industry simply should not be calling the shots anymore,” she said. “They’ve been calling the shots for over 75 years in what little federal regulation there is.”

She cited tests that have turned up lead in lipstick, formaldehyde in hair care products and mercury in face cream.

The cosmetics industry has called some of those findings misleading and unnecessarily alarming, noting that the FDA found no level of lead in lipstick that would pose health concerns.

Compared to its authority to oversee pharmaceuticals and foods, the FDA remains virtually toothless when it comes to regulating cosmetics. It has no power to review products before they go on the market.

Companies do not have to list all of the ingredients in their products, and they do not have to register their manufacturing facilities with the government. They also are not required to report “adverse events,” making it difficult for regulators to spot potential problems.

Other countries have put in place far more stringent regulatory systems. The European Union, for example, has banned the use of about 1,300 chemicals in consumer cosmetics products. By comparison, the FDA has banned fewer than a dozen, most of which were listed in the 1970s and 1980s, the agency said.

However, some companies have made changes in the wake of consumer demands. Johnson & Johnson recently reformulated its iconic baby shampoo and other products after pledging to remove formaldehyde and another chemical that regulators have deemed potentially harmful, even as it has maintained that the products were safe.

Print manufacturing fraught with safety hazards

The U.S. Department of Labor's Occupational Safety and Health Administration has cited Artbeats Inc. for repeat and serious violations of workplace safety standards at its Cheshire facility in Connecticut.

The company, which manufactures reproductions of prints and paintings, faces $56,430 in proposed fines following an inspection by OSHA's Bridgeport Area Office begun Dec. 3, 2013, in response to a worker complaint.

Inspectors found several hazards similar to those cited in June 2010 at the company's Waterbury facility.

These hazards include failing to provide a program to ensure workers are trained to power down and lockout industrial saws prior to conducting maintenance; provide a chemical hazard communication program and training on the risks and safeguards associated with chemicals, such as paints and gels; and prevent usage of unapproved electrical equipment in areas that generate and accumulate combustible wood dust.

"Left uncorrected or allowed to recur, these conditions expose employees to hazardous chemicals, fire, and lacerations and amputation by activated machinery," said Robert Kowalski, OSHA's area director in Bridgeport.

"An employer must ensure hazards are consistently and effectively addressed to provide employees a safe and healthful work environment."

The conditions resulted in the issuance of eight repeat citations, with $53,460 in proposed fines. Additionally, one serious citation, with a fine of $2,970, was issued for an inadequately guarded radial arm saw.

Artbeats Inc. has 15 business days from receipt of its citations and proposed penalties to comply, meet informally with OSHA's area director, or contest the findings before the independent Occupational Safety & Health Review Commission.

Fewer air pollutants released: EPA

WASHINGTON - Total releases of toxic chemicals decreased 12 percent from 2011-2012, according to the U.S. Environmental Protection Agency’s (EPA) annual Toxics Release Inventory (TRI) report.

The decrease includes an eight percent decline in total toxic air releases, primarily due to reductions in hazardous air pollutant (HAP) emissions.

“People deserve to know what toxic chemicals are being used and released in their backyards, and what companies are doing to prevent pollution,” said EPA Administrator Gina McCarthy.

“By making that information easily accessible through online tools, maps, and reports, TRI is helping protect our health and the environment.”

The 2012 data show that 3.63 billion pounds of toxic chemicals were either disposed or otherwise released into the environment through air, water, and land.

There was also a decline in releases of HAPs such as hydrochloric acid and mercury, which continues a long-term trend.

Between 2011 and 2012, toxic releases into surface water decreased three percent and toxic releases to land decreased 16 percent.

This is the first year that TRI has collected data on hydrogen sulfide. While it was added to the TRI list of reportable toxic chemicals in a 1993 rulemaking, EPA issued an Administrative Stay in 1994 that deferred reporting while the agency completed further evaluation of the chemical.

EPA lifted the stay in 2011. In 2012, 25.8 million pounds of hydrogen sulfide were reported to TRI, mainly in the form of releases to air from paper, petroleum, and chemical manufacturing facilities.

Another new addition to TRI reporting is a requirement for each facility located in Indian country to submit TRI reports to EPA and the appropriate tribe, and not the state where the facility is geographically located.

EPA finalized this requirement in a 2012 rule aimed at increasing tribal participation in the TRI Program.

This year's TRI national analysis report includes new analyses and interactive maps for each U.S. metropolitan and micropolitan area, new information about industry efforts to reduce pollution through green chemistry and other pollution prevention practices, and a new feature about chemical use in consumer products.

The annual TRI report provides citizens with critical information about their communities. The TRI Program collects data on certain toxic chemical releases to the air, water, and land, as well as information on waste management and pollution prevention activities by facilities across the country.

The data are submitted annually to EPA, states, and tribes by facilities in industry sectors such as manufacturing, metal mining, electric utilities, and commercial hazardous waste.

Many of the releases from facilities that are subject to TRI reporting are regulated under other EPA program requirements designed to limit harm to human health and the environment.

Also available is the expanded TRI Pollution Prevention (P2) Search Tool, which now allows users to graphically compare facilities within the same industry using a variety of environmental metrics.

Under the Emergency Planning and Community Right-to-Know Act (EPCRA), facilities must report their toxic chemical releases to EPA by July 1 of each year.

The Pollution Prevention Act of 1990 also requires facilities to submit information on waste management activities related to TRI chemicals.

Large corporations finally embracing green trend

Many large corporations are
committing to being greener.
Under pressure from NGOs, a slew of global companies that are number one in their industries made unprecedented commitments to better environmental and social behavior.

There is at least the chance that their promises are not greenwash.

In November, one of the biggest global brands announced it was joining the good guys. Coca-Cola, the world’s largest purchaser of sugar, declared it would stop buying from suppliers that did not adhere to its new guidelines on protecting land rights, which commit the company to "zero tolerance for land grabbing" and respect for land rights of communities and traditional groups.

The commitment was given to Oxfam, the UK-based aid and development NGO, which has been campaigning against land grabbing by sugar companies and others. Coca-Cola promised to publish independent social, environmental, and human rights assessments of its activities, and those of its suppliers.

Earlier in the year, in a move that could have major implications for the forests of Southeast Asia, there was a similar announcement from the world’s largest producer of paper products, Jakarta-based Asia Pulp and Paper (APP).

The company has long been a target for campaigners as it stripped the rainforests of Indonesia to feed its giant pulp mills. But last February it promised an immediate end to the clearing of natural forest by the company and its subsidiaries and suppliers. The company said it would switch to sourcing from timber plantations and that "where new plantations are proposed, APP will respect the rights of indigenous peoples and local communities, including recognition of customary land rights."

APP’s promise, which will be policed by the environmental group TFT, was enough to convince Greenpeace, which had accused the company of "pulping the planet," to call off its worldwide protests.

But perhaps the most far-reaching commitment came in December, when the world’s largest palm-oil trader, Singapore-based Wilmar, committed itself to ensuring that no more deforestation or peatland destruction was carried out by any company that fed its supply chain. Again, TFT will help monitor the company to make sure it delivers.

The pledge from Wilmar did not come out of the blue. It followed strenuous NGO campaigns to clean up the supply chain of an ingredient that is in one in three processed foods. And it came right after an announcement the previous month from foods giant Unilever, which is Wilmar’s biggest customer and is the world’s largest purchaser of palm oil. Unilever promised that by the end of 2014, it will have tracked its entire supply chain to ensure it meets its promise to end its role in deforestation. Arguably, Wilmar had little choice.

Nonetheless, things are getting interesting. The world’s largest companies and investors are starting to use their position as market leaders to drive up standards, rather than pushing them down. From retailers on up the chain, they are demanding that their suppliers clean up their acts. Could it become a "race to the top"?

Not everyone is convinced. Talk can be cheap, and other industry leaders have made such promises before.

So somebody has to make sure the reformed rainforest trashers and land grabbers live up to their promises. For now, that someone looks like TFT founder Scott Poynton, a brash Australian former forester who set up TFT in 1999. The Europe-based nonprofit, with offices in Switzerland and Britain, has been contracted by Wilmar, APP, foods giant Nestle, and a string of top companies to ensure that they do what they promise.

Poynton adamantly insists he won’t be anybody’s stooge. "We are painful, annoying, and strict. If things go wrong, we walk away. We have done that when companies are not serious and open with us — if we keep learning about things through the media, for instance."

What is involved, he says, is more than PR — it’s about changing the nature of the corporations.

Some CEOs clearly get it. Optimists hope that the industry leaders can be effective "first movers" and that other smaller players will follow. Pessimists fear that the others will simply see their big rivals as weakened by ethical compliance, and move in to take advantage.

If this really is a turning point — the moment a "race to the bottom" in corporate ethical standards becomes a "race to the top" — then we should soon know.

Fracking chemicals need to be disclosed: Oklahoma

Operators of all oil and gas wells in the state must report the chemicals used in hydraulic fracturing either directly to the website FracFocus.org or to the Oklahoma Corporation Commission, which will add the information to the FracFocus database.

The new regulation is an extension of a rule that required operators of horizontal wells in the state to disclose the makeup of their fracking fluids beginning in 2013.

The rules initially targeted only horizontal wells because that category represents most of the larger operators and about three-quarters of the wells drilled in Oklahoma in 2013, Corporation Commissioner Dana Murphy said.

“It's important to go ahead and include all wells because we want to treat all operators the same, but you have to focus where most of the activity is first,” Murphy said.

Corporation Commission rules for many years have required operators to report the chemicals used in drilling operation only if the commission asked for it.

Many operators began reporting their fracking fluid voluntarily in 2011 when FracFocus.org became operational.

“The issue is the public's desire to get the information,” Murphy said. “The new rule gives them confidence that we're doing our jobs as regulators and the industry is doing its job as well.”

Hydraulic fracturing, or fracking, is the process of using water, sand and chemicals to shatter rock deep below the surface and allow oil and natural gas to more easily flow to the well.

Oil and natural gas companies have been using hydraulic fracturing in Oklahoma for more than 60 years, but the process has become much more popular — and controversial — over the past decade as fracking has been combined with horizontal drilling and other improvements to let companies produce oil and gas from shale and other dense rock.

After more than 40 years of study, the U.S. government says it has found no evidence that common anti-bacterial soaps prevent the spread of germs, and regulators want the makers of Dawn, Dial and other household staples to prove that their products do not pose health risks to consumers.

Scientists at the Food and Drug Administration announced recently that they are revisiting the safety of triclosan and other sanitizing agents found in soap in countless kitchens and bathrooms.

Recent studies suggest triclosan and similar substances can interfere with hormone levels in lab animals and spur the growth of drug-resistant bacteria.

The government's preliminary ruling lends new support to outside researchers who have long argued that the chemicals are, at best, ineffective and at worst, a threat to public health.

"The FDA is finally making a judgment call here and asking industry to show us that these products are better than soap and water, and the data don't substantiate that," said Stuart Levy of the Tufts University School of Medicine.

While the rule only applies to personal hygiene products, it has implications for a broader $1 billion industry that includes thousands of anti-bacterial products, including kitchen knives, toys, pacifiers and toothpaste. Over the last 20 years, companies have added triclosan and other cleaners to thousands of household products, touting their germ-killing benefits.

Under a proposed rule, the agency will require manufacturers to prove that anti-bacterial soaps are safe and more effective than plain soap and water. Products that are not shown to be safe and effective by late 2016 would have to be reformulated, relabeled or removed from the market.

"I suspect there are a lot of consumers who assume that by using an anti-bacterial soap product, they are protecting themselves from illness, protecting their families," said Sandra Kweder, deputy director in the FDA's drug center. "But we don't have any evidence that that is really the case over simple soap and water."

A spokesman for the cleaning product industry said the FDA already has "a wealth of data" showing the benefits of anti-bacterial products.

The announcement affects virtually all soap products labeled anti-bacterial, including popular brands from CVS, Bath and Body Works, Ajax and many other companies.

The rule does not apply to hand sanitizers, most of which use alcohol rather than anti-bacterial chemicals.

An FDA analysis estimates it will cost companies $112.2 million to $368.8 million to comply with the new regulations, including reformulating some products and removing marketing claims from others.

The agency will accept data from companies and researchers for one year before beginning to finalize the rule.

The proposal comes more than four decades after the FDA began evaluating triclosan, triclocarban and similar ingredients. The government only agreed to publish its findings after a three-year legal battle with the Natural Resources Defense Council, an environmental group that accused the FDA of delaying action on potentially dangerous chemicals.

Triclosan is found in an estimated 75 percent of anti-bacterial liquid soaps and body washes in the U.S. More than 93 percent of anti-bacterial bar soaps also contain triclosan or triclocarban, according to the FDA.

The FDA was asked to investigate anti-bacterial chemicals in 1972 as part of a law designed to set guidelines for dozens of common cleaners. But the guidelines got bogged down in years of regulatory delays and missed deadlines. The agency published a preliminary draft of its findings in 1978, but never finalized the results until last week.

Most of the research surrounding triclosan's safety involves laboratory animals, including studies in rats that showed changes in testosterone, estrogen and thyroid hormones. Some scientists worry that such changes in humans could raise the risk of infertility, early puberty and even cancer.

FDA scientists stressed Monday that such studies are not necessarily applicable to humans, but the agency is reviewing their implications.

Other experts are concerned that routine use of anti-bacterial chemicals such as triclosan contributes to the emergence of drug-resistant germs, or superbugs, that render antibiotics ineffective.

In March 2010, the European Union banned the chemical from all products that come into contact with food, such as containers and silverware.

A spokesman for the American Cleaning Institute, a soap cleaning product trade organization, said the group will submit new data to regulators, including studies showing that company products do not lead to antibiotic resistance.

The group represents manufacturers including Henkel, Unilever and Dow Chemical Co.

Market growth for Chinese laser equipment slows down

The laser equipment market is expected to
continue growing at a single digit rate.
As a global processing and manufacturing center, China has continuously expanded the installation of laser processing equipment and occupied more than 10% of the global market.

However, due to weak downstream demand, the growth rate of Chinese laser equipment market in 2012 and 2013 both fell to below 10% according to the "Global and China Laser Equipment and Processing Industry Report, 2013-2017" from portal ChinaMarketResearchReports.com.

Among major enterprises, only Han's Laser Technology and Shenzhen Sunshine Laser and Electronics Technology have achieved business growth, says the report.

Other enterprises have realized little growth or negative growth. With continuous upgrading of processing and manufacturing industry, it is expected that the laser industry will see recovery growth and business performance will pick up in 2014 and 2015.

Han's Laser Technology is China's largest laser equipment manufacturer, says the report. Despite the laser industry downturn, Han's Laser Technology has maintained rapid growth, and achieved a year-on-year revenue growth rate of 18.53% in the first half of 2013. In particular, the revenue from high-power laser cutting equipment, laser welding equipment, and laser cutting equipment rose by 77.13%, 13.32%, and 35.03% year on year, respectively.

Shenzhen Sunshine Laser and Electronics Technology is China’s largest laser processing service company, says the report. The company occupies a big share of the laser template processing and laser forming service markets, which are expected to hit 21% and 13%, respectively, in 2013.

In the first half of 2013, the growth rate of its revenue from laser forming services, HDI drilling, and UV drilling  reached 41.63%, 119.33%, and 575.08%, respectively, displaying strong growth momentum.

The report also says that the European and American economic crisis, the Asian economic slowdown, and a number of other factors have affected the development of the global laser industry and reduced the growth rate of the global industrial laser sector to single digits.

The growth rate of the global laser system market declined from 16% in 2011 to 6% in 2012, and is expected to further drop to around 4% in 2013.

EPA to reduce federal inspections

The Environmental Protection Agency plans to substantially reduce inspections and civil enforcement cases against industry over the next five years, arguing that focusing on the biggest polluters would be the most effective way to clean up air and water.

In a draft strategic plan, the EPA proposes to cut federal inspections by one-third from the 20,000 inspections it conducted in the last fiscal year, ended Sept. 30.

Moreover, it plans to initiate about 2,320 civil enforcement cases a year, compared with the 3,000 cases initiated last fiscal year, a 23% reduction.

The EPA said the shift for fiscal years 2014 to 2018 is not a retreat from enforcement but a more effective allocation of resources.

Environmental groups are alarmed
over the EPA's plans.
"From our work on the biggest enforcement cases, such as the BP Deepwater Horizon spill, to aggressively pursuing smaller cases that can reduce harmful health impacts and have the greatest environmental benefit, our enforcement work will continue to save lives and protect our environment," said Alisha Johnson, an agency spokeswoman.

Representatives from industry organizations that frequently criticize the EPA, such as the U.S. Chamber of Commerce and the National Mining Assn., had no comment on the proposed changes.

Environmental groups said they were alarmed.

"It is bewildering why the EPA would pull cops off the beat who've been protecting our air and water from big polluters," said Michael Brune, executive director of the Sierra Club. "We urge the EPA to reconsider these proposed cuts."

In the draft strategic plan, the EPA said that focusing on the biggest violators would lead to the greatest cuts in pollution. The EPA also said that it planned to emphasize real-time monitoring of emissions to prevent pollution, which, if successful, would also lead to a decline in enforcement actions.

Still, some former EPA lawyers questioned the strategy. They said the EPA has long proposed real-time emissions monitoring but industry has successfully stymied implementation.

Eric Schaeffer, a former director of the EPA's Office of Civil Enforcement, said that tough enforcement in many ways was the most effective deterrent.

"They want to get at prevention, but the government in general is measured by what it does, and that is enforcement," said Schaeffer, executive director of the Environmental Integrity Project, a Washington research and advocacy group.

"If this is signaling some kind of wind-down in the bigger enforcement cases and bigger pushes that only EPA as the federal regulator can do, then it's worrisome," he said.

In the draft strategic plan, the agency cites budget constraints as a factor in reshaping its approach.
